These Terms & Conditions (“Terms”) govern your use of www.elliottflooring.co.uk (the “Website”) and any quotation, supply and installation of flooring or related services by TB Elliott Flooring (“we”, “us”, “our”). By using the Website or engaging our services, you agree to these Terms.

1) Definitions
  • Client/you: the person or company requesting a quotation or engaging our services.

  • Services: surveys, supply, subfloor preparation, screeding/levelling, underfloor heating, sanding/sealing, fitting/installation, and related works.

  • Goods: flooring materials, underlays, trims, adhesives and accessories supplied by us.

  • Contract: a binding agreement formed when you accept our written quotation (including any referenced schedule/specification).

2) Website use

Content is provided for general information and may change without notice. We aim for accuracy but do not guarantee completeness. Do not misuse the Website (e.g., introduce viruses, attempt unauthorised access). All intellectual property on the Website belongs to us or our licensors; you may not copy or reuse without permission.

3) Quotations & surveys
  • Fitter-led surveys: Our quotes follow an on-site or remote assessment. Quotes are typically valid for 30 days unless stated otherwise.

  • Assumptions: Quotes are based on visible/accessed areas and the information you provide. Hidden defects (e.g., excessive moisture, structural issues, asbestos, electrical/plumbing obstructions) may require variation.

  • Measurements & product selection: We will measure with care and advise on suitable materials, but final colour/finish choices remain the Client’s responsibility. Samples are indicative and may vary between dye lots or timber boards.

4) Orders, deposits & scheduling
  • A Contract forms when you accept our written quotation.

  • We may request a deposit for materials or to secure diary dates.

  • Lead times depend on product availability and required preparation. We will provide a realistic schedule and keep you informed of changes beyond our control.

5) Client responsibilities
  • Provide safe access, electricity, lighting, heating, water and clear working areas.

  • Remove furniture, appliances and fragile items unless we have agreed to handle them (charges may apply).

  • Inform us of known hazards (e.g., asbestos, uneven substrates, underfloor services).

  • Maintain ambient conditions suitable for flooring (temperature/humidity) and allow adequate curing/drying time where specified.

6) Subfloor preparation & tolerances
  • We install to manufacturer and industry standards. Acceptable tolerances depend on the floor type (e.g., flatness standards for plank/LVT/parquet; smoothness for sheet goods).

  • Where unforeseen issues are discovered (e.g., excessive moisture, weak/contaminated substrates, structural movement), we will propose remedial works and associated costs for approval before proceeding.

7) Materials, samples & variations
  • Timber and natural products vary in grain, tone and knotting; this is normal and not a defect.

  • Batch shades for carpets and vinyl may differ slightly from samples. We endeavour to supply matching batches where possible.

  • If a chosen product is discontinued or delayed, we will propose an equivalent or agree an alternative.

8) Installation & site conduct
  • Our installers are DBS-checked/NVQ-qualified where stated and work with dust-controlled tools and daily tidy-downs.

  • We will use appropriate fixings/adhesives and expansion allowances.

  • We may cut outdoors or in ventilated areas to control dust and noise. Reasonable noise/dust should be expected during work hours.

9) Underfloor heating (UFH)
  • We will follow commissioning protocols and temperature limits.

  • UFH must be switched off (and cooled) before certain works and brought back up gradually after installation. Failure to follow guidance may void warranties.

10) Payments
  • Invoices are due as stated on the quotation/invoice (typically on completion or staged for large projects).

  • Late payments may incur interest/administration charges as permitted by law.

  • Goods remain our property until paid in full, though risk passes on delivery/installation.

11) Cancellations, postponements & access
  • You may cancel before materials are ordered or works scheduled; special-order items may be non-refundable.

  • If access is not possible on the agreed date, we may charge for wasted time or rearrangement.

  • We may reschedule for reasons beyond our control (e.g., supplier delays, extreme weather, illness).

12) Defects & snagging
  • Please inspect on completion and note any concerns within 7 days.

  • We will remedy workmanship defects within a reasonable time. This does not cover fair wear and tear, misuse, improper maintenance, moisture ingress outside specification, or third-party alterations.

13) Warranties
  • Workmanship guarantee: We stand behind our fitting to the extent stated in your quotation/hand-over.

  • Manufacturer warranties: apply to Goods we supply, subject to their terms (proper site conditions, maintenance, cleaning products and temperature/humidity limits).

14) Returns & special orders
  • Cut-to-size Goods and special-order items are typically non-returnable unless faulty.

  • Faulty Goods will be repaired/replaced or refunded as required by law.

15) Liability
  • We are not liable for indirect or consequential losses (e.g., loss of profit, loss of enjoyment).

  • Our total liability for any claim arising from the Contract shall not exceed the price paid for the relevant Services/Goods, except for death or personal injury caused by negligence, fraud, or other liability that cannot be limited under law.

16) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., extreme weather, supply chain disruption, utility failures).

17) Complaints

Please contact us first; we aim to resolve issues quickly and fairly. If we cannot resolve a dispute amicably, you may seek alternative dispute resolution or pursue your legal rights.

18) Governing law

These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of its courts.

19) Changes to these Terms

We may update these Terms periodically. The “Last updated” date reflects the latest version. Material changes will be shown on this page.
